BNP faces prosecution for submitting ‘misleading’ accounts
The British National Party may face prosecution after providing accounts to the Electoral Commission that failed to give a “true and fair view” of its financial circumstances.
The far-Right party, which has already been fined for filing its accounts six months late, must produce further details by Friday.
The news comes as figures released by the commission yesterday reveal how the party exaggerated its spending during the European elections, in which it won two seats, including that of Nick Griffin, the party leader.
Mr Griffin has often claimed that the BNP spent more than £500,000 during the campaign. In fact, the party spent much less, £282,843 — only £54,000 more than it did during 2004.
Mr Griffin’s claims had raised eyebrows, —particularly because the party had declared less than £25,000 in donations since January 2008.
Simon Darby, the BNP deputy leader, yesterday blamed bureaucracy for the errors and said the party needed to exaggerate because “if we had said we wanted to spend 10p, it wouldn’t do us any good. ... there’s a bit of hyperbole with politics”. He refused to comment further on the discrepancy, saying that it was not a “worthy question”.
The BNP was fined £1,000 for filing its 2008 accounts in December — nearly six months after the original deadline.
Even then, the commission concluded that the accounts were inadequate and requested further information.
In his report, which prefaced the accounts, Mr Griffin blamed poor accounting on changes in the party’s treasury department. He said that the accounts had become too big for one person to manage, and had since been outsourced to a chartered accountant.
He said the changes were made “with the aim of presenting acceptable accounts for the accounting year 2009”. “We recognise that it is not acceptable to present inadequate accounts,” he wrote.
The independent auditor of the accounts concluded that the party’s financial statements did not “give a true and fair view” of its affairs. Silver & Co wrote: “In our opinion it cannot be said that the accounts comply with the requirements of the Political Parties, Elections and Referendums Act 2000, as adequate records have not been made available.”
A spokesman for the Electoral Commission said: “We have reviewed the statement of accounts and have concerns about them. We have written back to the party requesting additional information. Until we have received that information we cannot say what further action will be taken.”

If found guilty, Griffin could face a jail sentence
The British National party is facing a crisis in the run-up to the general election after it emerged that Nick Griffin, its leader, could be jailed over its illegal “whites only” membership policy.
Whitehall officials believe Griffin will be unable to comply in time with a court order forcing him to change the BNP’s constitution to admit Asians, blacks and members of other ethnic minorities.
They say the BNP’s membership is not due to vote on the constitutional change until after the court deadline expires towards the end of this month. Trevor Phillips, head of the government’s equalities watchdog, which won the legal ruling three months ago, has instructed his lawyers to be ready to ask the court to impose crippling sanctions, including a heavy fine or possible jail term against Griffin and Simon Darby, the BNP’s deputy leader.
If successful, the move could paralyse the right-wing party at a time when many at Westminster believe it is on the verge of winning its first seat in parliament with the support of disillusioned former Labour and Tory voters.

“The BNP is very much Nick Griffin’s party,” said one official. “Were he forced to stand down three months before an election, then what are the prospects for the party? He could be replaced by someone who was much more hardcore. They would potentially be in disarray.”
The legal action began last year when the Equality and Human Rights Commission issued county court proceedings against Griffin, Darby and Tanya Lumby, another senior BNP official.
The watchdog argued that the BNP’s constitution was unlawful because it restricted membership to particular ethnic groups and those whose skin colour is white.
Last October Judge Paul Collins agreed and awarded costs against the party. Griffin was forced to order a freeze on membership applications. The court gave him until January 28 to persuade the party to change its constitution and allow non-whites to join.
However, Griffin is unlikely to be able to deliver the change in time.

It will also be a focus for all those resisting the rise of racist anti-Muslim groups such as the English Defence League.
Speakers at the conference include: Ken Livingstone, Margaret Hodge MP, Dawn Butler MP, Yasmin Alibhai-Brown (journalist) and Michael Rosen (writer and broadcaster). There will be workshop sessions covering issues such as the BNP in the media, Love Music Hate Racism and organising against the BNP in your workplace.

Victory for anti-fascists as Durham University drops BNP event
Anti-fascist campaigners have welcomed the decision by University of Durham to cancel plans by the student debating society to invite a pair of Nazis in to speak against multiculturalism. The debating club had hoped to give a platform to leading BNP members Andrew Brons and Chris Beverley on Friday 12 February.
Brons has a criminal conviction for calling a mixed race policeman an "inferior being". He used to lead gangs of thugs round Leeds in the 1980s chanting "death to the Jews". Beverley was recently interviewed on BBC radio where he refused to condemn Hitler and instead compared the Nazi dictator to Alexander the Great.
The society's decision to extend an invite to the BNP was condemned by National Union of Students national officers and the Unite Against Fascism campaign. North East UAF and Student UAF supporters were planning to demonstrate against the BNP outside the venue had the debate gone ahead.
Weyman Bennett, joint secretary of Unite Against Fascism, said: "This is a victory for the people who were prepared to mobilise, organise and demonstrate against the Nazi BNP. It shows that when the anti-fascist majority gets active, the BNP can be defeated. The BNP is desperate to build a student wing and to start organising on campus - but we are not prepared to let that happen.
"We welcome the decision by the university to take the welfare of its ethnic minority students seriously. The BNP is dedicated is the elimination of all ethnic minorities from this country. You cannot have a 'reasonable debate' with such people. The physical presence of black, Asian and Jewish people in this country is not negotiable."
EDL cancels planned Bolton demo
The English Defence League has cancelled plans for its racist thugs to descend on the town of Bolton on Saturday 6 March. Reading between the lines of the garbled and paranoid statement released by the EDL leadership, it is clear that the organisation knew its crew of hooligans and Nazis would go on the rampage and attack a Hindu festival due to be held in Bolton that day.
The behaviour of the EDL at Luton in May last year and Stoke last month shows that when their thugs go on the attack, they threaten anyone and everyone who stands in their way - Muslim or non-Muslim, black, white or Asian. That is why it is so important for all of us to unite and show solidarity with Muslims under attack from racists.
UAF supporters in Bolton will be out campaigning against the EDL and BNP on Saturday 6 March. They will also be holding an event that day to celebrate and defend Bolton's multicultural and multiracial society - details to come. There is no room for complacency - the EDL is still threatening to attack Dudley on 4 April and Bolton later this year.
Another great UAF day of action in Barking
Some 100 activists turned out for UAF's second day of action in Barking on Saturday against Nick Griffin and the Nazi BNP. UAF ran a stall in central Barking and had a brilliant response from local people, with around 100 of them signing up to get involved.

BNP refuses to condemn insult to Queen
The BNP refused to condemn the GA's remarks about the Queen
The Green Arrow, a BNP supporting blog, has launched a revolting tirade against the Queen, calling her a “traitor”. The BNP have refused to condemn the site. Their toleration of the likes of the Green Arrow shows how there is nothing even remotely patriotic about the BNP.
The GA, which is run by Paul Morris, said that the 84-year old monarch is a “liar and a traitor to her people”.
This is not the first time that the GA has insulted Queen Elizabeth. In January 2010 he wrote:
“The time has come my friends to now talk of treason and sedition. Treason already committed by our own Queen and Sedition that should now be committed by all True British Patriots.
The Queen has already committed five acts of treason by signing EU treaties that have finally abolished Our Nation. She will go down in history as the only monarch to ever have broken her Coronation Oath. We owe her no allegiance and now have an actual patriotic duty to remove and replace her.”
On the Queen’s Christmas message he said his first reaction was to:
“… switch to Anglo Saxon mode and write “”F**k you and your descendants you treasonous bitch”"
He went on to urge British citizens to commit sedition:
“She is no Monarch of England or the UK, she is a craven coward who has betrayed Our Trust … The Queen has committed Treason, we must now commit Sedition as Our Patriotic Duty. Long Live the British National Party”
One could be forgiven for thinking that the GA is a lunatic and on the outer fringes of the BNP. However, in December 2008 he was invited as a “welcome guest” of Bridgend BNP. Morris’s blog is extremely popular amongst BNP internet users and has been used as a intermediary by sympathisers such as Bill Murray, former secretary of the Welsh BNP and Director of Soldiers off the Street, in their quarrels with anti-BNP campaigners over their links to the extremist party.

When contacted by Nothing British this morning, the BNP explicitly refused to condemn the GA’s un-patriotic and crude remarks about the Queen. A BNP press officer bizarrely told NB that it was us who were instead “low-life” and “un-patriotic”.
The BNP claim to be patriotic and wrap themselves up in the flag and the Armed Forces. But when the rabble rousing Anjem Choudhury screams for Shariah law and says that the Queen should wear a burka, the BNP and the GA shout out treason and say we have been betrayed by the Establishment for allowing him to say such things. The BNP have one system of values when condemning Choudhury but apply another one for themselves.

Far-right party told to address its entry criteria at extraordinary general meeting next month or face legal consequences
The British National party was warned tonight that it had one last chance to scrap its constitution or face legal action under equality laws.
Its leader, Nick Griffin, was told at a Central London county court session that new rules must be agreed at an extraordinary general meeting to be held next month.
The judgment saw BNP officials forced to rush out letters to members to alert them to the proposed changes.
The Equality and Human Rights Commission, which challenged the whites-only membership criteria last year, said the changes proposed still fell foul of equality laws.
John Wadham of the EHRC said the amended version, which refers repeatedly to "indigenous British", displayed indirect discrimination as opposed to direct discrimination. "It is not that much of an improvement," he said.
Judge Paul Collins said: "I'm going to give the BNP an opportunity to have its EGM and take into account what has been said today and get it right. I do not think there will be another opportunity to get it right. This is it." He also ordered the BNP to pay the £12,500 in court costs relating to the adjourned session.
A BNP spokesman Simon Darby said the party would have to "emasculate its constitution and drop its policies and principles" to comply with the court's wishes. "This is a deadly serious attempt to put us out of business," said Darby.
Simon Assaf, 41, from Unite Against Fascism, said he was grabbed round the throat and kicked after shouting "dirty racist" at Griffin outside the court.
Darby said BNP members had the right to protect themselves when attacked if the police failed to intervene.

His message came as Gordon Brown set a deadline of the middle of next year for "turning the tide" against the Taliban - suggesting that could be when soldiers start coming home.
The Prime Minister insisted the Nato campaign had to deliver swift results as a key conference in London agreed a process for giving the Afghan government responsibility for security.
The communique issued by the high-level gathering called for a gradual handover starting from the end of this year. Kabul should assume full control over security in the troubled country within five years, according to the document.
Mr Brown admitted that 2009 had been "difficult" and there would be "more tough times ahead".
"All our forces have made great sacrifices, with hundreds of lives lost and thousands of casualties sustained," he told delegates. "In the last year Britain alone has suffered over 100 fatalities. But these sacrifices are not in vain - all the countries represented here recognise that this campaign is vital to our own national security, to the stability of this crucial region, and to the security of the world."
The leaders - including US Secretary of State Hillary Clinton - set a target for Afghan security force numbers to top 300,000 by October 2011, complementing Nato's military "surge" that will see around 135,000 troops on the ground. The conference also pledged 140 million US dollars of funding for plans put forward by Afghan President Hamid Karzai to reintegrate Taliban fighters who are prepared to renounce violence.
A "loya jirga" - or grand assembly of elders - is to be held in Afghanistan to try to bring more people into the effort to rebuild the country.
Speaking after the summit, Mr Ban said there was unanimous support from the international community that it should continue to provide necessary resources - political, financial and economic support. It also backed a transition towards more responsibility on the part of the Afghan people and government in the security area.
He also acknowledged the losses sustained by British troops in the troubled country: "I know that more than 250 British young people gave their lives in the cause of peace and stability in Afghanistan. That has been a very noble sacrifice, but I'm sure that their sacrifice will be long remembered for peace and stability in Afghanistan."

Visitors walking in snow and cold at the former Nazi death camp of Auschwitz-BirkenauElderly Auschwitz survivors have gathered in the snow at the site of the former death camp to mark the 65th anniversary of its liberation.
Survivors, some with grown children - and others there to honor the millions killed by the Nazis - moved among the barracks and watchtowers of Auschwitz and Birkenau, neighbouring camps that stand as powerful symbols of the Holocaust.
Israeli Prime Minister Benjamin Netanyahu joined Polish leaders for commemorative ceremonies at Birkenau, the larger of the two camps, where about a million Jews were murdered.
The tribute marks the day the Red Army liberated the camp in 1945, and is part of worldwide events on International Holocaust Remembrance Day - established by the United Nations in 2005 as a global day of commemoration.

At the Vatican, the German-born Pope spoke of "the horror of crimes of unheard-of brutality that were committed in the death camps created by Nazi Germany."

Israeli President Shimon Peres addressed to the German parliament, calling for the surviving perpetrators of the Holocaust to be brought to justice.
"Across the world, survivors of the Holocaust are gradually departing from the world of the living," he said. "At the same time, men and women who took part in the most odious activity on earth - that of genocide - still live on German and European soil, and in other parts of the world. My request of you is: Please do everything to bring them to justice."
The Nazis opened Auschwitz as a concentration camp in the summer of 1940 after it invaded and occupied Poland.
Because of its central location, Germany soon turned it into a centre for implementing the 'Final Solution', the plan to wipe out Europe's Jews.

A SOLDIER in Prince Charles' regiment is today exposed as a Nazi fan and BNP supporter.
Anthony Phipps proudly shows off a Nazi tattoo and pictures of SWASTIKAS on his Facebook page.
In one snap, he and some pals appear to be making hateful Sieg Heil gestures used to salute Adolf Hitler.
Another shows a tattoo featuring a Nazi Party-style eagle standing on top of a St George Cross. Phipps makes clear his racist beliefs by stating his political views are "BNP".
Although being a BNP member is not banned in the armed forces, it is frowned upon by top brass.
Last night, it was revealed that Phipps has gone AWOL. He is being hunted by Military Police - who on Friday raided an address in the West Midlands - as well as facing a carpeting over his sinister political beliefs.
No one visiting Birmingham-based Phipps' Facebook page is left in any doubt about his vile opinions.
The frontline infantry soldier serves in 3 Mercian Regiment (Staffs), whose Colonel in Chief is Prince Charles. Yet he lists his political beliefs as: "BNP. i.e. Pride, Power and Patriotism. No surrender, EVER."
He even set up his own Facebook group in early 2009 asking pals if they would vote for him if he ran for the racist party.
As a soldier in 3 Mercian - formerly known as 1 Staffords - Phipps will have been in Iraq in early 2007.
An MoD spokesman said last night: "We can confirm an investigation concerning a serving soldier is currently under way.
"The Army does not tolerate racist behaviour and those who are found to fall short of the Army's high standards will be dealt with appropriately."
A senior military source said: "Being a multi-cultural unit, we are horrified and appalled. There is a lot of anger about the shame he has brought upon us all.
"He's not fit to wear the uniform"
He added: "Phipps was a bit of a loner. He could not be trusted and would always take the easy option."

This is an utter disgrace and is a stain on the proud heritage and tradition of the British Army. 70 years ago our solders where giving their lives fighting Germanys Nazis. 70 years later people have not learned from past mistakes and we have Nazis and racists in the British Army.
As Colonel in Chief Prince Charles needs to deal with this vile little Nazi. Phipps does not represent us, he does not represent the armed forces and I'm ashamed of him ever being part of the British Army.
